FCI gets rap for delay in pension to widow
Chandigarh, April 17 The forum has directed the corporation to pay 9 per cent interest on the delayed pension, compensation of Rs 1 lakh and Rs 7,000 as litigation cost. Significantly, this amount has to be recovered from the salaries of the officials who delayed the pension. Further, the commission has said that if this all isn’t done within three months, the entire amount shall be recovered from the salary of the Zonal Manger (North),
FCI. The orders were passed on the complaint of Kamini Walia, whose husband, Satish Kumar, died on January 8, 2001, while in service. She had alleged that though all requisite documents for the release of family pension were submitted on June 28, 2003, the same was released on September 7, 2010. During these seven years, the complainant claimed that she had made several visits to the FCI for the release of the pension but no one listened to her. She stated that she had even sent a legal notice on May 16, 2010, but nothing positive came out. In its response the FCI claimed that they had received the papers two and half years after Satish Kumar’s death and the same were incomplete. They said the documents were only submitted to the Employer Provident Fund Organisation on August 11, 2010 and the payment was finally released on September 7, 2010. The forum observed that it had been established beyond doubt that the FCI “not only slept over the matter of granting family pension to a widow of an ex-employee, who was burdened with the liability of rearing here two young sons, but that they have been absolutely callous, indifferent and cruel to her fate in keeping the case pending for a period of more than seven years even after submission of all FPS papers”. The forum ruled that the gross deficiency in service, as well as indulgence in an unfair trade practice, had been fully established on FCI’s part. |

Dress designer penalised Rs 28,000
Chandigarh, April 17 The amount includes cost of the dress, compensation and litigation cost for supplying the dress. The forum comprising Rajinder Singh Gill and Madanjit Kaur Sahota passed the order while allowing a complaint filed by Sector 21 resident Anjana Mehta. In her complainant, Anjana stated that she visited Hotel Taj in Chandigarh on September 3, 2010, for an exhibition, where she selected a dress and placed an order with Rimple and Mayur on full and final payment of Rs 20,000. But the complainant did not receive the dress following which she made numerous calls that were put off by the respondent on one pretext or the other. Finally, after repeated reminders, when the complainant received the dress on October 12, she was shocked to see that it was dirty and old. It rather appeared to be the piece that the exhibitors had kept for trial and had been tried by many customers during the exhibition. After hearing the complaint, the forum held that it was of the opinion that there was deficiency in service as well as unfair trade practice on the part of the dress designer. It directed the designer to refund Rs 20,000 and also told it to pay Rs 5,000 as compensation for harassment along with the litigation cost of Rs 3,000. |
