HC notice to Bar Council

Chandigarh, July 2
The Punjab and Haryana High Court today issued a notice of motion to the Bar Council of India (BCI), the Union Government and other respondents on a petition challenging Bar examinations filed by Ashima Bindlish and three other students of Panjab University’s final year of law.

Issuing the notice, the Bench comprising Justice MM Kumar and Justice AN Jindal directed the BCI to show cause whether it was empowered to frame rules under the Advocates Act

Initially, the petition came up for hearing before the Division Bench of Justice Hemant Gupta and Justice Alok Singh. But as Justice Singh expressed reservations on hearing the matter, Justice Gupta directed the case to be fixed before an appropriate Bench, in which Justice Alok Singh was not a member. In their petition, the students contended that the BCI had no powers to make such rules and impose unreasonable conditions.

The petition stated that BCI could not impose any pre-enrolment condition for a graduate to be granted a licence to practice. It could not impose post-enrolment conditions, like qualifying an exam in absence of any express power conferred on the BCI. — TNS

Even many hoteliers, who were cashing in on FIFA fever, now feels that Brazil’s defeat would decrease their clientele. Many were seen disappointed by Brazilian stopper Mello, who was held responsible for the first self-goal, which turned out to be suicidal for the team.
