Nari Niketan Rape Case
Court asks for names of victim’s caretakers

Chandigarh, May 18
The court of additional district and sessions judge GC Garg has directed officials of Nari Niketan to submit a report stating the names of the caretakers who had assisted the mentally retarded rape victim during her stay there. The prosecution had moved an application seeking appointment of an assistant to be present with the victim to help the court during the latter’s crossexamination. On May 13 the UT administration had pleaded that one person should be allowed to assist the victim during her crossexamination.

The counsels for the rape suspects, however, opposed the application yesterday only. The defence counsels contended no one had any right to intervene in any capacity in the trial. They further contended the plea on the grounds that the proceedings of the case were being held in camera and the public prosecutor, the suspects, their counsel and the judge’s staff were the only persons who should be present to render assistance in the trial of the case.

The judge today asked Nari Niketan officials to submit a report to the court stating the names of people who had assisted the victim with her day-to-day chores during her stay at the institution. The judge has fixed May 25 as the next date of hearing in the case. — TNS

Dyslexia As Disability
HC issues notice to Union ministry
Tribune News Service

Chandigarh, May 18
The Punjab and Haryana High Court today issued a notice of motion to the Union Secretary, Ministry of Social Justice and Empowerment, and other respondents on a petition for treating dyslexia as a disability and considering dyslexic students for reservation among physically challenged.

The petitioner, Chandigarh resident Pranjay Jain, in his petition, sought HC directions for reservation for dyslexic students during the All-India Engineering Entrance Examination (AIEEE) and the Joint Entrance Examination (JEE).

The petition stated that physically handicapped students were eligible for three per cent reservation of seats under the provisions of the Disability (equal opportunities, protection of rights and full participation) Act.

In March, the Delhi University had passed orders after taking note of an affidavit filed by its Registrar, who had conveyed the decision of the Vice-Chancellor to treat dyslexia as a disability for granting reservation.

The authorities of the Union ministry had filed a counter-affidavit that dyslexia could be considered a disability.

The petition filed by Pranjay was first listed before Justice Permod Kohli on May 13, who held that the issue raised by the petitioner needed amendment in the provisions regarding disability.

It was, therefore, referred to a division Bench. Onkar Singh Batalvi, counsel, Union of India, received the notice on behalf of the ministry.
