Fun Republic Case
Chandigarh, March 31 The alleged scam had come to the fore in 2007, after the CBI detected building violations at Fun Republic multiplex in Mani Majra. After an independent inquiry, the CBI registered a case for allegedly causing losses to government through building violations and misusing
public posts. Justice Daya Chaudhary issued the directions for quashing the FIR “qua” Dhillon on the Congress leader’s petition filed through counsel Vinod Ghai. He had argued that Dhillon was only the owner of the site, leased out to E-City Entertainment for 25 years. He had nothing to do with the alleged violations and the multiplex; and was just a signatory. The development is significant as Dhillon, Atul Goel of M/s E-City Entertainment, sub-divisional officer TP Singh, assistant engineer Brij Mohan, draftsman Sandeep Sharma and architect Arun Loomba stand charge-sheeted in the case. The CBI had claimed that Dhillon, Goel and Loomba, in connivance with officials of the building branch, cheated the government of around Rs 6.28 crore. The prosecution had claimed that undue profits were made by Dhillon Brothers Private Limited, and M/s E-City Entertainment, while the Chandigarh administration suffered loss as form ‘B’ dated June 19, 2006, was issued in blatant violations of Rule 18 of the Capital of Punjab (Regulation and Development)
Act, 1952. The charge-sheet had also stated that officials of the building branch extended undue favours to M/s Dhillon Brothers, while sanctioning the building plan and granting occupation certificate by ignoring the serious violations of building bylaws. Conversion and composition charges of around Rs 95.96 lakh, including Rs 9.18 lakh for converting offices spaces to Athena Pub and Bar on the fourth floor of the building, were not collected from the company, thus causing loss to the government exchequer, the charge-sheet filed by the CBI had claimed. |

He averred that he showed them documents about clearance of his old loan but in spite of that, the bank refused to issue the NOC. Finally, a legal notice was sent to the bank but it elicited no reply. The bank, in its reply, admitted the factual matrix of the case and stated that the NOC for the loan was not issued to the complainant, as the same was under lien on account of the pending dues in earlier loan taken by him. It was also stated that the complainant had failed to give details qua the closure of his earlier loan amount. The complainant produced the receipt pertaining to his old loan case. The amount found due under the personal loan agreement was waived off and the personal loan account was closed, and the lien imposed in the auto loan account was cleared.
