High Court Saurabh Malik Tribune News Service
Chandigarh, February 5 Justice K Kannan asserted: “The bureaucratic mindset of lethargy must go; inertia must give place to quick response”. The Judge has also made it clear that “defiance shall be tellingly punished”. The clarion call came on a petition filed by Khushal Singh and other public information officers (PIO) with the CBSE. They had challenged the imposition of fine by the information commissioner for non-compliance of orders on information directed to be given. Justice Kannan said: “The RTI Act ushers in a new era of transparency in the functioning of public offices and the duties of public authorities. We ought to be heading for a situation that a lot of information regarding public offices ought not to be required to be demanded to be secured. On the other hand, the information must be forthcoming on their own. Every public institution ought to be running its affairs with a degree of transparency that would instantly evoke public confidence”. Justice Kannan ruled: “The Central Information Commission was dealing with a case, where information had been sought with regard to information of certain schools in CBSE Shiksha Kendra, New Delhi. The response had not been forthright and the CIC found that they were evasive. “After notice was issued under Section 20 of the Right to Information Act, the information commission noticed that the information that had been originally denied despite directions from the Commission was given only after proceedings were taken under Section 20”. Justice Kannan added: “The information commission found there was a defiance of the statutory orders. The information commission also found there was no written explanation by the PIO, but he was only stating that he had not understood the nature of information sought and hence, he did not immediately respond to them. Under such circumstances, the information commission thought it was a fit case for levying penalty…. He fixed maximum penalty of Rs 25, 000 and directed the amount to be paid by the Chairman, which could be recovered from the salary of the persons responsible for causing delay.” |
