Saketri mandir takeover
Chandigarh, December 4 In a petition, the Shiv Mandir Nav Durga Charitable Trust has sought directions to the state of Haryana, Panchkula deputy commissioner, urban local bodies director and another respondent for quashing the order of acquisition of the temple management. Describing the total procedure adopted by the state as illegal and without jurisdiction, the petitioners contended the move had been initiated due to non-application of mind. The petitioners contended the process was being undertaken on false and frivolous grounds, without even granting an opportunity of hearing to the petitioner trust and without verifying the facts. It was further contended on the petitioner’s behalf that the trust had never ever faced the allegations of mismanagement. Going into the background of the matter, the petitioners said in 2004, an effort was made to “acquire the management” by asking it to give detailed accounts. The petitioner added the place where the temple was situated was the UT Additional 18 kanal and six marlas were purchased subsequently for social activities in the Saketri village. This was pointed out to the authorities concerned and no action was taken. But all of a sudden, without verifying the “correct facts” a “decision proposal has been sent without inquiry with malafide intention and vested interest by making a false ground of mismanagement and complaints for acquisition of the temple management”. Taking up the matter, the High Court Division Bench of Justice Uma Nath Singh and Justice A.G. Masih issued a notice of motion for December 22. |
