Role of rent Act discussed
Chandigarh, December 16 Speaking on ‘Landlord-Tenant Relations in Chandigarh: Role of the Rent Act’, Dr Jauhar enlightened the DCS faculty about the technicalities of the Rent Act in layperson’s language. Stating how the Urban Rent Control Act, 1944, was extended to Chandigarh he said, law enactment in property matters was based on three philosophies: laissez faire, regulator procedural measures and the contract mechanism. He said the third philosophy is very sparingly used in landlord-tenant relationship but it was due to this philosophy that the Punjab Urban Immovable Property Tax came into being and the imposition of Punjab Urban Rent Control Act, 1941, took place. “It is a statutory law and Chandigarh is governed by it”. He further informed the audience that property matters fall within the purview of both the General Law and the Special Law. In the event of a conflict between the two, the Special Law prevails. If tenancy is governed by General Law status of tenant is that of a contractual rent and under Special Law tenant becomes statutory tenant and is therefore entitled to automatic protection available under the statute. |

Hyundai told to give new Santro engine: forum
Chandigarh, December 16 The complainant, Dr Manoj Gupta, alleged that he had bought a new Santro car from Messrs Charisma Gold Wheels Pvt Ltd., Chandigarh on March 21, 2004. It was alleged that the car was giving a very low mileage and engine oil was leaking. The problem of oil leakage continued even after the oil seal was replaced. Thereafter, the vehicle was given to the dealer for repairs on July 8, 2004. When the complainant went to take delivery of the vehicle on July 14, he was told that the engine had been overhauled. In reply to the complaint, the auto company said the engine had to be overhauled due to use of adulterated fuel by the complainant, which is a common problem in vehicles plying in Panchkula. The counsel for the complainant, Mr Pankaj Chandgothia, cross-examined the officers of the auto company by submitting a written questionnaire. While answering the questionnaire, it was admitted by them that they did not have any instrument to check fuel adulteration and the fuel was never checked by them. They further admitted that the fuel was not changed and rather, the same fuel was re-filled in the fuel tank, even after overhauling. The forum, headed by its president, Mr N.S. Ahlawat, held that the company had itself admitted defect in the original engine, since they had overhauled the engine within four months and at a reading of only 3071 km. The defense of fuel adulteration had not been proved by the auto company. The forum observed that “the engine of the new car sold to the complainant was inherently defective. The clandestine overhauling of the engine without the permission of the complainant is gross unfair trade practice. The predicament of a customer who spends about Rs 3.50 lakh on acquiring a new car can well be imagined when its engine is overhauled within four months. An over-hauled engine cannot be at par with original factory-sealed engine.” The company was directed to replace the overhauled engine with a new and complete factory-sealed engine and fit the same at its own cost with renewal warranty. The complainant has also been held entitled to Rs 50,000 as compensation and Rs 2,100 as costs of litigation. |

An evening of ghazal magic
Chandigarh, December 16 “Ye alag baat hai saki” Or Sardar Anjum’s classic “Rang pyar waala pao pehle tod di liyao”, such rare blend of meaningful lyricism of philosophical content and subtle romanticism, dexterously rendered in the mellifluous voice of Pankaj Udhas, lit up the opening function. After a mundane start the performance picked up momentum as the maestro ploughed more deeply to dole out ghazals in romantic radical mould like “Deevaron se mil kar..” and “Ye zamaana khaab hai’which were well received. Pankaj interspersed spells of “sargam jugalbandi” with musicians on mandolin and violin generating applause in “Laa pila de sakia.” He frequently used “komal” and “shudh” gandhar and nishaad with immaculate expertise. He also doled out his ghazils hit “Chithi ayyee hai” and local poet S.L. Rakesh’s classic “Thodi thodi piya karo.” “Peene wale suno naa chhupa ke piyo kabhi ishaq aur husan ko mila kar piyo” and “Chandi jaisa rang hai tera” rendered in his unique innocent style won applause especially from foreign delegates. Besides some ghazals penned by Dr Sardar Anjum and sung by Pankaj in hit Punjabi albums like “Baisakhi” and “Khushian da rang..” the prolific singer also doled out hit numbers like Mein kapde badal kar”, “Chandi jaisa rang hai tera” and many
