Ludhiana, May 28
Mr Sunil Arora, Additional Sessions Judge-cum-presiding officer of the fast-track court has sentenced Parmod Shah of Railway Colony to two years’ imprisonment on the charge of killing a cyclist, Sahibdin, while driving his vehicle rashly.
The accused was booked under Sections 279, 427 and 304-A, IPC, on May 23, on the statement of Bikker Singh. Later, the Judicial Magistrate, Mr R.K. Sharma, committed the case to the sessions courts, with the observation that prima facie the case fell under Section 304 (culpable homicide not amounting to murder).
“I am of the view that the initial act of the accused, as a result of which the accused suffered injuries, falls under the definition of 304-A, IPC, but the subsequent act of the accused in taking injured in his vehicle on the pretext for admitting him to the Civil Hospital and leaving him on the way, resulting in the death of Sahibdin, falls under the definition of offence under Section 304, IPC, Mr Sharma had said in his order.
The accused was charged under Section 304, IPC, by the sessions court but no offence under this Section was proved with the testimonies of prosecution witnesses. After hearing the arguments, the fast-track court came to the conclusion that it was a case of accident.
