Ludhiana, April 9
The District Consumer Disputes Redressal Forum has directed the Ludhiana Improvement Trust to execute a sale agreement, in a month, in favour of an aggrieved consumer and to hand over the possession of the plot allotted to her.
The forum has directed the trust not to demand any non-construction charges from the complainant, Savita Pabbi of Nur Mahal, till two years after the delivery of the possession of the plot.
The complainant had pleaded that the Improvement Trust had allotted her a plot measuring 100 sq yrds (no. 103-G), under the Shaheed Bhagat Singh Nagar scheme for a consideration of Rs 11,000. Entire amount was paid by way of instalments, but she was not given the same plot which was allotted to her earlier.
It was further alleged that the opposite party made illegal demand of two more instalments, despite the fact that the entire amount had already been paid. Even the possession of the plot was not handed over to her.
The opposite party contended that the consumer was at fault, as she had not paid the seventh and the eight instalments. It was also pleaded that even the sixth instalment was paid late and the consumer was also liable to pay the non-construction charges.
After hearing both the parties, Mr Hardyal Singh, President of the forum, held that the fact of making payment of all instalments by the consumer stood proved. He further observed that the Improvement Trust had allotted an alternative plot to the consumer, which showed that it was not in a position to hand over the possession of the plot, allotted to her earlier, so they were not entitled to claim any non-construction charges or the interest on delayed payment.
