Godara, Additional District and Sessions Judge, on September 2,1999, to restrain defendants from using the property for commercial purpose. The complainant, said that his wife, Satinder Kaur, was the owner of half of the house, 2109 at Sector 15, Chandigarh, and the remaining half portion was owned by Veeran Devi. The plot of this house was allotted by the Estate Office on condition that the only a residential building would be constructed. The complainant alleged that the other half of the building was being used by the respondent for commercial purpose such as tuition and coaching classes and it amounted to nuisance. The respondent in their reply claimed that the appellant was nobody to complain and that the allegation regarding nuisance was wrong and suit had been filed only to harass them. During the proceeding, the Local Commissioner visited the spot and submitted a report before the judge. According to the report, the commercial activity was still going on in the premises in the disputed area. The Judge allowed the application, subject to the condition that the SHO would investigate the matter on his own and if there was a need for implementing the order of the court dated September 2,1999, and police help was required the SHO would assist the complainant in getting the order implemented and make a report to the court in this regard. |
