2G: SC dismisses all but Centre’s review petition
New Delhi, April 4 The court, which decided to hear on April 13 the Centre's plea for review of the February 2 verdict relating to policy, however, rejected its petition to have a re-look into its findings that sanction for prosecution of public servants can be sought even prior to filing of complaints. The government had sought review of the judgment to the limited extent of policy, saying that the apex court had entered into the exclusive domain of the executive and beyond the limits of judicial review. A Bench of Justices GS Singhvi and KS Radhakrishnan said Raja's apprehension that his case in the trial court would be prejudiced due to the verdict cancelling the 2G licences is "not well founded". Companies whose review petitions were dismissed are Videocon Telecommunications Ltd, S Tel Ltd, Sistema Shyam Teleservices Ltd, Tata Teleservices Ltd, Unitech Wireless (Tamil Nadu) Pvt Ltd, Etisalat DB Telecom Pvt Ltd and Idea Cellular Ltd. "We have carefully perused the review petition and the record of the case and are convinced that the judgment of which review has been sought does not suffer from any error apparent warranting its reconsideration," the Bench said. While rejecting the Centre's plea on the issue of sanction in which the Prime Minister's Office was pulled up, the Bench said its verdict did not suffer from any error and under the garb of review petition rehearing and reconsideration of the issue decided cannot be allowed. "We have carefully perused the averments contained in the review petition and the grounds on which the petitioner (Centre) has sought review of the judgment and are convinced that the judgment of which review has been sought does not suffer from any error apparent warranting its re-consideration. In the garb of review, the petitioner cannot seek re-hearing of the matter and re-consideration of the issues decided by the court. The review petition is accordingly dismissed," the Bench said.

New Delhi, April 4 "We will now move a curative petition and again urge the Supreme Court to keep its order in abeyance until these arguments are seen and appreciated by the new Bench," Uninor said in a statement. On February 2, the Supreme Court had cancelled 122 telecom licences given to various operators in 2008 under then Telecom Minister A Raja on the grounds that they were issued in a "totally arbitrary and unconstitutional manner." While Uninor (a joint venture between Norway's Telenor and Indian real estate major Unitech) lost 22 of its licences, 21 licences of SSTL were quashed. "It is extremely disappointing to know that SSTL's review petition has not been accepted. To protect its interests further, SSTL currently is in the process of deliberating its future course of legal actions," SSTL said in a statement. The company said it will provide further comments after studying the Supreme Court's order on the review petition in
