HC stayed CLB order in Marc Rodrigues case on Aug 14
Next hearing on petitions on Nov 20

The Tribune on November 6 last had reported that the Principal Bench of the Company Law Board (CLB) at New Delhi, headed by member, Ms Vimla Yadav, had on July 2, 2009, held that a Delhi-based entrepreneur Ashok Chawla made out a “prima facie case of collusion and connivance” between a company, called Crystal Island Park Limited, and Marc William Rodrigues, who is son of Gen S.F. Rodrigues (retd), the outgoing Governor of Punjab and Administrator of UT Chandigarh.

Available information suggests that on August 14 last, Justice A.H. Joshi of the High Court of Bombay at Goa granted an interim stay on the CLB’s orders on a petition filed by Crystal Island Park Limited.

Marc William Rodrigues too filed a separate petition, through his lawyer, and also got a stay on the CLB orders of July 2, 2009.

It is learnt that High Court of Bombay at Goa Bench of Justice N. A. Britto had earlier granted another stay on the CLB proceedings in the case of Marc William Rodrigues versus Ashok Chawla and others on November 11, 2008.

This stay was granted on the petition of Marc William Rodrigues.

However, Justice Britto, after hearing the pleadings of both the sides, vacated this stay of November 11, 2008, on the CLB proceedings, and directed the parties to appear before the CLB on March 12, 2009.

It is reliably learnt that the petitions about the CLB proceedings are likely to come up for further hearing before Justice Joshi in Goa on November 20 next.
