Public schools cannot lay down admission criteria
IS a public school entitled to lay down its own admission criteria for the students belonging to the weaker sections? The answer is “No”. After the Delhi High Court decision of January 20, 2004, in Social Jurist case, followed by the Delhi Government order of April 27, 2004, directing the public schools of Delhi to give admission and freeship to the extent of 25-20 per cent to children belonging to the weaker sections, all public schools are now inventing ways and means to frustrate both the High Court and the government. A public school built on a public land, having reluctantly admitted only 10 students from the weaker sections in the academic year 2004-05, has now issued a circular to the parents the 10 students, informing them that a decision has been taken by the school managing committee that the proof of family income, duly issued by the competent authority, should be submitted every year; and asked them to submit a fresh proof of income certificate by the SDM. Another public school has inserted an advertisement in newspapers, inviting applications for admission in the pre-primary class, subject to the conditions that the applicant has to purchase admission form against a payment of Rs 10 each from the school and the applicant should be residing within a radius of 1 km from the school. Several other schools are subjecting students and their parents to rigorous tests and interviews, irrespective of whether it is an admission at the entry level or the student has a valid school-leaving certificate. The admission to almost all students are denied, saying that the student or his or her parents failed to clear the test/interview. The authority to lay down any admission criteria exclusively rests with the government/land owing agency. However, the agency is bound to lay down a criterion that advances the object underlying therein and not to defeat it. This authority flows from both the conditions of the land allotment and the provisions of the Delhi School Education Act, 1973. Public schools have no authority to devise their own admission criteria for students falling under the weaker-sections quota. Rule 145 of the Delhi School Education Rules, 1973, which empowers the head of every recognised school to regulate admission to a recognised unaided school or to any class thereof (either on the basis of admission test or on the basis of result in a particular class or school), has no application at all to the admission of students falling under the weaker-sections quota. The schools cannot have any objection to the admissions as long as the limit does not exceed the weaker-sections quota of 25-20 per cent. The government, in its order-dated April 27, 2004, has laid down admission criteria to be followed by all schools in letter and spirit. It is not only legally impermissible, but also unjustified that schools devise own arbitrary criteria for admission. The schools are going to the extent of verifying the correctness of the parental income certificates issued by the SDM, which is unwarranted. A school cannot charge money for the admission form when it is expressly disallowed to do so under the government order of April 27, 2004. More than 2 lakh children of the poor would be eligible for admission and freeship in public schools under the weaker-sections quota. How will it be possible for parents of these 2 lakh children to approach the SDM every year to obtain the parental-income certificate for allowing their children to remain in these schools? The demand for submitting such certificates every year is nothing but a device to harass parents. How can a school put a residential-distance limit of 1 km when no such limit has been laid down in the government order or in the land-allotment letter. However, the same schools are happily catering to hefty-fee-paying students living even 15-20 km away from the school. The schools have been opposing the PIL in Delhi High Court seeking directions for adherence to the neighbourhood school concept by all schools. The schools apply the neighbourhood school concept only when it’s the question of admission of students belonging to the weaker sections. The schools are adopting double standards. The schools are equally unauthorised and unjustified in subjecting students/parents to test and interview. How a child at the entry level can be subjected to test and interview when the Delhi School Education Act, 1973, prohibits any such test before class I. How can a student holding valid school transfer certificate be denied admission on the basis of such certificate. If schools were allowed to devise their own admission criteria, no student covered under the weaker-sections quota would ever be admitted and even the students who have been admitted would be pushed out sooner or later. The government and the land-owning agency are the sole authorities to decide the admission criteria and public schools have no say in that. |
Campus notes: Himachal Pradesh University, Shimla THE appointment of Dr V. D. Sharma as the new Registrar of Himachal Pradesh University (HPU) has ended the hectic lobbying for the administrative post. The appointment of Dr Sharma, Principal of Evening College, came as a surprise to everyone, as those claiming to be close to the ruling party circles had been hoping to get the coveted post. Aspirants from the teaching as well as non- teaching category had been visiting the powers that be, so that they could replace Mr Ashok Sharma, who was transferred after holding the post for only a year. The manner in which the appointment has been done has raised a number of questions. Initially, it was the Controller of Examination, Mr K.P. Dogra, who was given this additional charge till further orders. Finally, the government appointed Dr Sharma as Registrar, but that too is additional charge till further orders. He will continue to be Principal of the Evening College while holding the additional charge. However, it is being felt that having a non-administrative person as Registrar was much more convenient for the authorities. Police to stay The campus has virtually been transformed into a cantonment with heavy deployment of police, following frequent clashes between various student organisations. With six students getting injured in clashes between the Students Federation of India (SFI) and the Akhil Bharatiya Vidyarthi Parishad (ABVP) on May 10, it seems that the police has been deployed permanently on the campus to avoid further violence. With the tenure of the present Students Central Association (SCA) coming to an end on June 30, the police is extra careful, as chances of further clashes are high, in view of the fresh elections. Even as students prepare for semester examinations, there is tension, as skirmishes are taking place every now and then. Seminar wave In the last one month, various departments of the HPU held a number of international and national seminars. The Department of Physics organised a three-day international workshop on Nuclear Structures at the Extremes: New Dimension, in which more than 100 participants and nearly 20 eminent scientists from Europe, America, and China gave their views on the subject. A two day-seminar on Nehru and his Contemporaries orgnaised by the Nehru Study Centre was aimed at analysing Panditji’s interaction with his contemporaries for evaluating his role and contribution in the post-colonial era. The Department of Social Sciences, Canadian Study Centre and the Department of Chemistry also organised seminars. Eyes on verdict The controversial issue of termination of the services of three teachers of the HPU is still hanging fire. The matter is to be taken up at the next meeting of the Executive Council (EC). However, with the case coming up for hearing in the High Court on May 19, the authorities keenly await the court verdict. Mr Ajay Srivastava, Reader in the Department of Journalism; Ms Mamta Sharma, lecturer in bio-sciences; and Dr Kuldeep Chand Agnihotri, Director, Regional Centre, Dharamsala, were the three teachers whose services were terminated. Meanwhile, the new Himachal University Teachers Association (HUTA), the breakaway group of teachers supporting their three colleagues, has also gone slow on the issue after holding dharna for a few days. The issue had generated heat in the last three meetings of the Executive Council, as some members alleged political victimisation. |
