Three High Court Judges summoned

The Chief Justice of India has summoned three senior Judges of the Punjab and Haryana High Court to New Delhi on Saturday for consultations on the crisis that has gripped the High Court.

According to information, the three Judges who have been asked to come to New Delhi are Mr Justice G.S. Singhvi, Mr Justice V.K. Bali and Mr Justice H.S. Bedi. These Judges were among the 25 judges who went on leave to register their protest against the Chief Justice of the High Court. They are also the seniormost Judges of the High Court after the Chief Justice.

Meanwhile, a day after they went on mass leave to register their protest against the Chief Justice of the Punjab and Haryana High Court, all the 25 dissenting judges returned to work today.

Their decision to calloff the protest was apparently taken after Supreme Court Judge Mr Justice Rajendra Babu talked to some of the judges and asked them to resume to work. Mr Justice Rajendra Babu will become the Chief Justice of India on May 2.

SC moved against HC judges’ action

A public-interest litigation (PIL) has been moved in the Supreme Court against the Punjab and Haryana High Court judges going on leave en mass yesterday. The judges had resumed their work today only after the apex court's intervention.

The PIL, filed jointly by two advocates, was mentioned late in the night at the residence of Chief Justice V. N. Khare, who assured the petitioners of taking appropriate action in the matter, besides listing of the petition for early hearing.

Advocates R. K. Rathore and S. S. Dhiya, who filed the PIL, today said that the PIL might be listed for hearing tomorrow as a request had been put up to the Supreme Court Registrar for its early hearing.

Though the high court judges resumed work today, the petitioners would press for deliberation by the court on the entire issue and the circumstances that led the judges to take such a decision, Mr Rathore said.

The advocates in the PIL said the act of the judges "is liable to be condemned. It is unsustainable in law."

"The decision of the puisne judges of the high court will shake the confidence reposed by the citizens of the country in the judiciary and the judicial system," the petitioners said while seeking a direction to the High Court Registrar to submit the entire records of the case.

It said the decision was not only contrary to the law and public interest, but also was against judicial propriety and ethics and violated the provisions of the Constitution.

"The judges of the high court are not entitled to take such a decision which indicates that they are reacting against any act or omission committed on the part of the system which they do not like. Such a decision of the judges amounts to strike," the PIL said.
