HC issues notice to Bibi

CHANDIGARH, Nov 27 — Mr Justice Surinder Singh Nijjar of the Punjab and Haryana High Court today issued notice to the CBI and the SGPC President, Bibi Jagir Kaur, for December 13 to show cause as to why anticipatory bail granted to her in the Harpreet Kaur death case should not be cancelled as per the allegations levelled by Kamaljit Singh.

Alleging blatant “misuse of the concession of anticipatory bail”, Kamaljit Singh, a young man of Begowal village in Kapurthala district of Punjab and who claims himself to be the husband of the late Harpreet Kaur, on Saturday last moved the Punjab and Haryana High Court seeking cancellation of the anticipatory bail granted to Bibi Jagir Kaur on November 15 by Mr Justice Surinder Singh Nijjar.

Bibi Jagir Kaur has been booked by the CBI under Sections 302,304,342,313,201 and 120-B of the IPC for the alleged murder of her 19-year-old daughter Harpreet Kaur after aborting her child.

Kamaljit alleged that on November 22 Bibi Jagir Kaur came to Begowal and stayed for the whole day in the house of Dalip Singh Tibbewala. “Later, a number of persons were incited by the Bibi to take action against the petitioner and his family”, Kamaljit had alleged in his petition. A TV crew which included Ms Bhawna Ahluwalia had come to record a programme to be telecast on Doordarshan. She along with other crew members came to the house at about 5 p.m. on November 22. As the petitioner was not at home she waited for him and the petitioner reached home around 5.30 p.m.

“Immediately thereafter, a crowd of 200/300 persons consisting of men, women and children, most of them drunk, gathered outside the house of the petitioner. They started abusing and threatening the petitioner and his family. From amongst the crowd, the petitioner could identify Dalip Singh Tibbewala, Asa Singh, Surinder Singh Rubi, Paramjit Kaur, Balbir Kaur, Manjit Kaur (teacher and daughter-in-law of a close relative of a very high judicial officer), Janak (cook of the dera), Balwinder Kaur, Narinder Kaur, Balbir Singh and his wife and Amrik Singh,” Kamaljit said in his petition.

Fearing a serious threat to his life and his family, the petitioner spoke to SHO, Begowal on the telephone. The police officer was not at the police station but was accompanying the Bibi at her dera. The police did not take any action and the petitioner met the SSP Kapurthala the next day and submitted a complaint against some of the persons he had identified. But the police lodged a simple FIR against some unknown persons but not against those whom he had mentioned in his complaint, Kamaljit had alleged in his petition.
